1. Acceptance of Terms

By accessing and using AgentDeploy.cloud ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our Service.

2. Description of Service

AgentDeploy.cloud provides one-click deployment of AI agents — including Hermes Agent — on dedicated servers. We enable users to deploy, manage, and access pre-configured agent instances with full root SSH access and dedicated resources.

Each deployment gives you a dedicated box with a static IPv4 address, a subdomain under agentdeploy.cloud, and your chosen agent ready to chat via the integrations you configured.

3. Authentication

AgentDeploy.cloud uses secure authentication managed by better-auth. You may sign in with your GitHub or Google account. By using these methods, you agree to the respective terms and privacy policies of GitHub and Google. These providers may collect basic information such as your email address, name, and device data. We only store your email address and display name.

4. User Responsibilities

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and SSH keys
• Use the Service in compliance with all applicable laws and regulations
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to gain unauthorized access to any systems or networks
• Take responsibility for all activity that occurs under your account

5. Prohibited Uses

You may not use our Service to:

• Distribute malware, viruses, or any harmful software
• Conduct denial-of-service attacks or network abuse of any kind
• Send spam or unsolicited bulk communications
• Host or distribute illegal content
• Violate any third-party rights including intellectual property rights
• Mine cryptocurrency
• Engage in any activity that places excessive or unreasonable load on our infrastructure
• Any other unlawful or harmful activities that we determine to be inappropriate at our discretion

6. Payment and Billing

Services are billed on a fixed monthly or annual basis. Payments are processed securely by Polar.sh. You may switch between monthly and annual billing at any time, with changes taking effect at the start of your next billing period.

All payments are non-refundable. When you pay for a server, you retain access for the full billing period. If you cancel, the cancellation takes effect at the end of the current billing period.

Prices are subject to change, but any changes will only apply to new deployments and will not affect existing active servers during their current billing period. Failure to pay may result in suspension or termination of your account.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

8. Intellectual Property

The agents deployed through our Service (including Hermes Agent) are open-source software distributed under their respective licenses. AgentDeploy.cloud's platform, branding, and infrastructure tooling are proprietary and may not be reproduced without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, AgentDeploy.cloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, us, or third parties, or for any other reason we deem appropriate. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after such modifications constitutes acceptance of the updated terms.
